1. Who we are

This website is operated by Point of View Holdings (Pty) Ltd, trading as POV Holdings ("POV", "we", "us"), a South African business offering automotive photography, video and content (POV Media), sales coaching (POV Performance, in partnership with MiLife), clothing (POV Collection), a dealership content system (POV Program), a course (POV Growth) and Meta advertising (POV Meta, in partnership with ConversionCo). 2. Accepting these terms

By using this website, sending an enquiry or buying from us, you agree to these terms. If you do not agree, please do not use the website. These terms are governed by the laws of South Africa, including the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and, where it applies, the Consumer Protection Act 68 of 2008 (CPA). Nothing in these terms limits any right you have under those Acts.

3. Quotes and services

Most POV services are quoted individually. A quote is valid for 7 days from the date it is issued.
Any applicable taxes are shown on your quote.
A service agreement starts when you accept a quote in writing (including by email or WhatsApp). Scope, schedule and payment terms are set out in the quote or service agreement, which takes precedence over these general terms if they differ.
Delivery times, such as same-day stock imagery or 24-hour video turnaround, are targets we work hard to meet. Delays caused by weather, access to vehicles, or circumstances outside our control are not a breach.

4. Online purchases

Products such as the POV Package (POV Growth) and POV Collection items are sold through our online store. Prices are shown in South African rand. Payment is processed by our payment provider; we do not see or store your card details. Your order is confirmed once payment is received. Refund and cancellation rights are on the Refunds tab.

5. Intellectual property

All content on this website, including photographs, video, text, logos and the POV name and marks, belongs to POV or its clients and is protected by copyright and trade mark law. You may not copy, reuse or sell it without our written permission.
Unless your service agreement says otherwise, clients receive a licence to use the images and video we deliver for marketing their own vehicles and business. POV may show this work in its portfolio, on this website and on social media unless you ask us in writing not to.
Course material in the POV Package is licensed to the buyer for personal use only. It may not be shared, resold or recorded.

6. Reviews you post

If you leave a review, you confirm it is your honest opinion of a real experience with POV. We may remove reviews that are false, offensive, unlawful or unrelated to POV. By posting, you allow us to display the review on this website.

7. Use of the website

You agree not to misuse the website, attempt to break its security, send spam through its forms, or use it for anything unlawful. We may update, suspend or remove any part of the website at any time.

8. Liability

We take care to keep the information on this website accurate, but it is provided for general information and may change. To the extent the law allows, POV is not liable for indirect or consequential loss arising from use of the website. This does not limit liability that cannot be excluded under the CPA or other law, including for gross negligence.

9. Links to other sites

This website links to WhatsApp, our online store and partner businesses. Those services have their own terms and privacy policies, and we are not responsible for them.

10. Disputes and contact

If something goes wrong, contact us first at info@povholdings.co.za or 078 688 0944 and we will try to resolve it within 10 business days. You may also approach the Consumer Goods and Services Ombud or the National Consumer Commission. We may update these terms from time to time; the date at the top shows the latest version.

Privacy policy

1. Responsible party and information officer

The responsible party for your personal information is Point of View Holdings (Pty) Ltd, trading as POV Holdings. Our information officer is Robert Christopher Denny, reachable at info@povholdings.co.za.

2. What we collect

Enquiries and quotes: your name, mobile number, dealership or business name, the service you're interested in and anything you write to us.
Purchases: your name, email, phone, delivery address and order details. Card payments are handled by our payment provider; we do not receive your card number.
Email updates: your email address, if you sign up for POV alerts and updates.
Reviews: the name, business, rating and text you choose to post, linked to your signed-in account so you can edit your own review.
Website usage: if you accept analytics cookies, pages visited, device and browser type, approximate location, and how you arrived (for example the advert or link you clicked).
Client work: photos and video of vehicles and dealership premises. If people appear in our content, we ask for their permission.

3. Why we use it

To reply to enquiries, prepare quotes and deliver the services you buy.
To process orders, payments and deliveries.
To show reviews and improve our website and services.
To send you POV updates, alerts and offers by email only if you signed up for them or are an existing client, as section 69 of POPIA requires. Every email has an unsubscribe option, or email info@povholdings.co.za to be removed.
To meet our legal and tax obligations.

We rely on your consent, the need to perform a contract with you, our legitimate interest in running and improving our business, and compliance with the law, as POPIA allows.

4. Who we share it with

We do not sell your personal information. We share it only with service providers who help us operate, under confidentiality and data-protection obligations: our hosting and website platform, our online store and payment provider, WhatsApp (Meta) when you message us, Google Analytics if you accept analytics cookies, and our partners MiLife (POV Performance) and ConversionCo (POV Meta) where you buy their joint service. Some of these providers store data outside South Africa; we use providers that offer adequate protection as required by section 72 of POPIA.

5. How long we keep it

We keep enquiry information for up to 2 years, client and transaction records for 5 years as tax law requires, and reviews until you delete them or ask us to. After that we delete or anonymise it.

6. How we protect it

We use access controls, secure providers and encrypted connections to protect your information. If we become aware of a breach that affects you, we will notify you and the Information Regulator as POPIA requires.

7. Your rights

You may ask to see the personal information we hold about you, ask us to correct or delete it, object to us using it, and withdraw consent or opt out of marketing at any time. Email info@povholdings.co.za. If you are not satisfied with our response, you may complain to the Information Regulator: complaints.IR@inforegulator.org.za, www.inforegulator.org.za.

Cookies

Cookies are small files a website saves in your browser. We use as few as possible.

Essential

Needed for the website to work, for example remembering your cookie choice and keeping you signed in to leave a review. These are always on.

Analytics (optional)

If you choose "Accept", we use Google Analytics to understand how visitors use the site and which adverts bring enquiries, so we can improve. If you choose "Essential only", these are not set. You can change your choice any time using the Cookie settings link at the bottom of every page.

Refunds and cancellations

Online purchases: 7-day cooling-off

For goods bought online, such as POV Collection clothing, you may cancel without reason within 7 days of receiving the goods, under section 44 of ECTA. Return the item unused and in its original condition; the only cost to you is the direct cost of returning it. We refund the full purchase price within 30 days of cancellation.

POV Package (digital course)

The POV Package gives you immediate access to course material. When you buy it, you ask us to start the service straight away and agree that, once access has begun, the 7-day cooling-off right no longer applies, as section 42(2) of ECTA allows for services that begin with your consent. If you have not yet accessed the course, contact us within 7 days of purchase for a full refund.

Defective goods

Under the CPA you may return defective goods within 6 months for a repair, replacement or refund. Contact us first so we can sort it out quickly.

Services (photography, video, coaching, ads)

Monthly services may be cancelled with 30 days' written notice unless your service agreement says otherwise. Work already completed and costs already incurred are payable. Shoots cancelled with less than 24 hours' notice may be charged.
